Terms of Service

1. Acceptance

By installing or using Help Her Take Photo (the "Service") you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Help Her Take Photo lets two paired phones share a live camera feed so one partner can direct the other while taking a photo. The Service is provided free of charge, "as is", on a best-effort basis with no uptime guarantee.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.

4. Acceptable Use

You agree NOT to:

• Use the Service to capture or share images of any person without their consent.
• Use the Service to capture images of minors in any inappropriate context.
• Use the Service for surveillance or spying on anyone, including your partner without their explicit consent.
• Reverse-engineer, decompile, or attempt to extract the source code beyond what the open-source license permits.
• Use the Service to violate any applicable law, including privacy and image-rights laws in your jurisdiction.
• Abuse the infrastructure (excessive pairings, automated traffic, attempts to circumvent rate limits).

5. User Content

You retain all rights to the photos you capture. By using the Service, you grant us only the limited technical right to store and route those photos to your paired partner. We claim no ownership over your photos and we do not use them for training, marketing, or any other purpose.

6. Open Source

The source code is open source under the license declared in the GitHub repository (https://github.com/kensaurus/help-her-take-photo). Use of the source code is governed by that license, separately from these Terms.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE AUTHORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or are abusing the infrastructure. You may stop using the Service at any time by uninstalling.

10. Changes

We may update these Terms as the Service evolves. Material changes will be announced in the in-app changelog. Continued use after a change constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which the maintainer resides, without regard to conflict of law principles.
