Terms of Service

1. Acceptance

By installing or using help her take photo (the "Service") you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

help her take photo lets two paired phones share a live camera feed so one partner can direct the other while taking a photo. The Service is provided free of charge, "as is", on a best-effort basis with no uptime guarantee.

Optional AI credit packs pay for AI photo analysis beyond the free daily allowance. They are one-time in-app purchases, not subscriptions, billed by the App Store or Google Play. Credits are added to your account and can be used in all our apps on that account. "Our apps" means the apps made by kensaurus LLC, listed at https://kensaur.us. Refunds follow the policy of the store you bought from.

Purchased credits do not expire. They can't be exchanged for cash or moved to another account, except where the law requires it. See https://kensaur.us/tokushoho/ for the full credit terms and our legal notice under the Act on Specified Commercial Transactions (特定商取引法に基づく表記).

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.

4. Acceptable Use

You agree NOT to:

• Use the Service to capture or share images of any person without their consent.
• Use the Service to capture images of minors in any inappropriate context.
• Use the Service for surveillance or spying on anyone, including your partner without their explicit consent.
• Reverse-engineer, decompile, or attempt to extract the source code.
• Use the Service to violate any applicable law, including privacy and image-rights laws in your jurisdiction.
• Abuse the infrastructure (excessive pairings, automated traffic, attempts to circumvent rate limits).

5. User Content

You retain all rights to the photos you capture. By using the Service, you grant us only the limited technical right to store and route those photos to your paired partner. We claim no ownership over your photos and we do not use them for training, marketing, or any other purpose.

6. Source Code

The source code of the Service is proprietary. These Terms give you no rights to it.

7. What We Don't Promise

We work to keep the Service running and its AI feedback useful, but we can't promise that it will always be available or free of errors, or that every defect will be fixed. What we are responsible for when something goes wrong is set out in section 8.

8. Our Liability to You

If we harm you on purpose or through gross negligence, we are fully liable under the law. If we harm you through ordinary negligence, we are liable only for the direct and ordinary damage it causes, up to the greater of the amount you paid us in the 12 months before the harm happened or ¥10,000. This limit never applies to death or personal injury.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or are abusing the infrastructure. You may stop using the Service at any time by uninstalling.

10. Changes

We may change these Terms when the Service or the law changes. Before a change takes effect, we post the new Terms on this page with the date it takes effect. If the change is significant, we also announce it in the in-app changelog.

11. Law and Disputes

Japanese law governs these Terms. If there is a dispute, the Tokyo District Court hears it first. If you use help her take photo as a consumer, this doesn't take away the protection the law of the country where you live gives you, or your right to bring a claim in a court there or in any other court the law lets you use. Before going to court, please email us. Most problems are easier to fix that way.
